Al. Capone Commences Legal Action. STATUTE OF LIMITATIONS. NEW YORK, September 22. Another effort to obtain his freedom was made by Al. Capone yesterday. Handcuffed to guards he appeared in the Federal Court at Atlanta in habeas corpus proceedings to set aside his sentence. The ground of the application was that the statute of limitations forbade punishment for violations of the income tax regulations which occurred three years before the charges were laid. The hearing of the petition was set down for October 10.
