REHEARING GRANTED.
IMPRISONED GARDENER
EMPLOYERS GOOD REPORT.
On the grounds that new and material evidence in his favour relating to the charge had been discovered, since lie was sentenced to throe months' imprisonment on January :) for being a rogue and vagabond, John Barclay, an elderly gardener, applied for a re-hearing before Mr. W. H. Woodward, S.M., at the Police Court to-day.
Evidence was given by a farmer that he had employed accused for the past three years, and had found him a hard worker and an honest man. He was not a rogue and vagabond, and he had his position to return 'to. Witness, when shown accused's liat of previous convictions, admitted that occasionally Barclay took too much liquor when lie came to town, and he then got into trouble.
The • magistrate, after hearing evidence, remitted the balance of tin; sentence. Barclay was released, and was convicted and ordered to come up for sentence .if called upon within six months. He was also prohibited.
