■ * —' YOUNG CHINAMAN IN COLLISION. CONDITIONAL LEAVE GIVEN. (By Telegraph.- 4 -Fress Assbciation.) WELLINGTON, Monday. A further stage in the protracted litigation in the case, George Benson versus Kwong Chong, was reached in the Court of Appeal this morning, when Mr. Hanna, counsel for Benson, applied for leave to appeal to the Privy Council from the judgment of tho Court of Appeal, delivered last session. Chong is a market gardener, of Aramoho, and Benson a motor driver. At a third trial damages were awarded to Benson for injuries he received in a collision between his ni6tor cycle and a motor car driven by Chong's son. Motions for judgment arid for a new trial were moved into the Court of Appeal, which upset the jury's finding, and sent the case back to the lower Court to enter judgment for defendant, on the ground that the finding was perverse. "Mr. Hanna intimated that if leave to appeal were given, an application would bo made to the Privy Council itself for permission to prosecute the appeal in forma paupcris. Conditional leave was granted, security being fixed at £500, to be arranged within three months.
