BANKRUPTCY PETITION.
APPLICATION FOR WITHDRAWAL,
"Surely a creditor is entitled to withdraw his petition," said Mr. Justice Reed, when counsel for a debtor submitted, in the Supreme Court yesterday, that his client was entitled to be adjudicated a bankrupt. His Honor remarked that he had never heard of such a. petition before. The debtor, an Auckland land agent, who was i'n Wellington, had sent his counsel, Mr. Hunt, a statement to be handed into court after the order for adjudication was made. To Mr. Hunt's surprise counsel for the petitioning creditor, asked that the petition be withdrawn. Mr. Hunt said the debtor did not desire any further adjournment. The explanation of the creditor's action was that he was satisfied the debtor had. no estate and no benefit could come from a bankruptcy. At Mr. Hunt's request the petition was adjourned, on the condition that the creditor did not revoke his application for withdrawal,
