MAGISTRATE GIVES WARNING.

HAMILTON, this day.

Discovered under the influence of liquor in a mine, John Tudor, driver of the haulage engine at Glen Afton colliery, was charged to-day at Huntly with a breach of Regulation 72 of the Mines Act. "W. Barclay, inspector of mines, said Tudor was discovered by a deputy, W. Summers, at eleven p.m. in an inebriated state, and was escorted, from the mine. In Tudor's crib bag in the machinery house was a bottle of whisky. Asked if he had anything to say. defendant replied; "I may as well say nothing. It was hot pure whisky. -There was water in it." ilr. F. H. Levien, S.M., said it was most dangerous and serious for a person in charge of machinery to be intoxicated, especially underground. It was a menace to all workers. Tha magistrate said the offence merited a heavy fine. As the case was the first of the kind and the inspector did not press for a heavy penalty, and as Tudor had since been relegated to a minor position, ho would be fined £3 only. The magistrate gave a warning that no future offender would receive sympathy.
