OTAHUHU TRAFFIC BY-LAW.
OVERTAKING OF VEHICLES. PROHIBITED AT INTERSECTIONS. Consideration was given last evening by the Otahuhu Borough Council to the proposed by-law to prohibit vehicles overtaking others. . ilr. A. Breed, traffic inspector, said the only requirement seemed to be to control the rate of speed through the town. Safety was not lessened by the act of vehicles overtaking when inovinsr in the same direction, but the danger seemed to be in the increased speed when overtaking. The proposed bv-law was operating in only two places in the ; Dominion, and in both instances applied > to bridges—Grafton Bridge, Auckland, ] and the Hamilton Bridge.
The borough solicitor, Mr. B. W. F.j Wood, said that the Supreme Court had laid it down that by-laws tending to interfere with the rights common to all the King's subjects must be scrutinised' I with much greater care than by-laws which only affected the inhabitants of the district. If the proposed by-law were passed, it was almost certain to [ involve the council in expensive litigation. ° Mr. Pearce said the danger to children in the borough was so real, and some control of motor traffic so necessary, that he would be prepared to go on with the by-law and test it in the Court. . Petrie said every councillor was m sv mpathy with the intention behind the by-law, but in the multiplicitv of motor regulations they must avoid" becoming ridiculous, an*d be guided bv expert advice. Eventually the council decided to adopt the Hamilton Borough Council's by-law, forbidding any vehicle overtaking another on an intersection. The council also decided not to permit an increase in the speed of buses when passing through Otahuhu.
