MORTGAGED CATTLE SOLD.

FARMERS TO BE PAID MONEY,

(By Telegraph—Own Correspondent.) HAMILTON, Tuesday.

Mr. Justice Herdman to-day ordered that the sum of £2041 held by the Farmers' Auctioneering Co. on behalf of Mrs. Gladys Ryan, of Matamata, be handed to William Andrew and John Kirkness, farmers, of. Matamata.

The plaintiffs, Kirkness, held a mortgage over the estate of Edward Fitzgerald, deceased. Their claim was for the proceeds of a sale of stock in the Fitzgerald Estate, which had been sold by "the auctioneering'' company under instructions from Mrs. Ryan, who had not obtained probate of the will, although she was named as a beneficiary in the estate. At a later stage probate was granted in Ireland in favour of Mary Fitzgerald, the other executrix named in the will.

By agreement the sum of £31 10/ was allowed to the defendant company in full settlement of costs. Judgment was. entered against Mrs. Ryan by default.
