CLAIM ABANDONED.
WESTFIELD DEVIATION. LAND TAKEN BY GOVERNMENT. A claim for compensation for an area of four acres in Orakei Road, Remuera, taken in 1023 by the Railway Department for the Westfield deviation, was abandoned this morning by counsel for claimant, because it was discovered that claimant had no lease of the property which could be enforced. Mr. G. P. Finlay represented the claimant, Caroline Howard Byers, and Mr. V. Meredith, the Minister for Railways. Mr. Finlay said the claim was based upon a right of renewal of a lease taken in 1915. In the course of investigations it was found that a right of renewal could not be enforced, and claimant could not now have a better claim than then, therefore the claim had to be abandoned. His Honor (Sir Alexander Herdman): She has no lease at all then; no lease was even entered into. Under those circumstances the Court will award nothing, as plaintiff is entitled to no compensation. . The assessors, Mr. E. C. Blomfield, for the Minister of Railways, and Mr. G. B. Osmond, for plaintiff, were allowed £12 12/ each. Costs were not asked for.
