The level crossing- -fatality whi;>. occurred at Forest Lake Road \»i December 1, when Alexander"" Join. Hamilton was killed, was again " Illsubject of Court proceedings" to-day, when Patrick Deegan was charged with having driven a car while intoxicated, thereby causing the death of Hamilton. The evidence was similar to that given at the coronial inquiry on Monday.

Accused, who was represented by Mr J. F. Strang, pleaded not guilty an' reserved his defence: He was commit! < C for trial at the Hamilton Supreme Court bail being allowed as before.

At the coronial inquiry* the coroner. Mr. Wyvern Wilson. S.M*.. found "That the death of Hamilton was caused byinternal injuries and shock sustained through a collision between a train and a motor car driven by Patrick Deegan. in which car deceased was a passengei further that Patrick Deegan at the time of the collision was in- a state of intoxication and did negligently drive the car and fail to keep a proper lookout for approaching trains; that the whistle of Uh< train was sounded when approaching tincrossing and no blame was attachable U. the driver of the train."
