"You are a young man on the threshold of your career, and a young man of ability, and it may be that your trouble is that you are over sanguine," said Mr. Justice Blair in the Supreme Court this morning, in admitting .Edward Savile Lyall Esdaile (28), to five year's probation in respect to false pretences. Esdaile, who' was extradited from Suva when on his way to the United States, to develop an agency for a marine motor partnership, obtained £250 from Dr. H. A. Cooper by representing that he had two co-directors in the Art and Publicity Company of Xew Zealand, and that the sum was required to purchase the interests of the directors in the company. Actually there was only one other director, and he held but five shares. Mr. G. P. Finlay, for accused, in discussing the probabilities of restitution, said that Esdaile had only two assets in the world, one an interest in the marine motor syndicate, and the other in the Art and Publicity Company, and he was prepared to hand them over to Dr. Cooper. A good margin should be returned from the winding up of the Art Company. His Honor said he made tip his mind to give prisoner probation. In deciding to license him he was hopeful that he would justify the leniency shown him. It seemed to his Honor that Esdaile must return the money he had got by false pretences. Therefore one of the terms of his probation would be that he must return the £250 in such terms as the probation officer decided.
