COLLAPSE OF TUNNEL.
PICTURE THEATRE CLOSED. HEAVY DAMAGES CLAIMED. WRITS ISSUED AGAINST NEW LYNN TOWN BOARD. Writs claiming heavy damages have been issued against the New Lynn Town Board by H. Oakley Browne, proprietor of the Delta Picture Theatre, at New Lynn, and Mr. G. V. Mullenger, owner of the building. This is the outcome of the subsidence of a wall and the foundations of the building while tunnelling operations for the new sewerage scheme were in progress. The collapse occurred on May 13 last, and since then the theatre has been closed, a resolution having been passed by the board at a special meeting to cancel the license until the building was put into a position to enable it to be used for the purpose originally designed. The writ against the board on behalf of Mr. Browne was issued by Mr. Hall Skelton, while Mr. G. P. Finlay issued a writ on behalf of the owner against the board and the contractors, W. Stevenson and Sons. The case is set down to be heard during the coming session of the Supreme Court before a judge and jury of twelve.
