JUDGE'S OBSERVATIONS.

After an hour's retirement, the jury, in the defended divorce case in which Ralph Gordon Player (Mr. McLiver), builder, of Auckland, petitioned against Elizabeth Frieda Wilhelmina Player (Mr. Singer), on the ground of misconduct, found for the petitioner. A decree nisi was granted, to be made absolute in three mouths. The defence was a direct denial of misconduct.

Giving evidence, respondent said she and her husband always quarrelled. He used to go home intoxicated, and throw things about. She absolutely denied the allegations made against her. Mr. Singer pointed out to the jury that petitioner had not decided to take proceedings till he had been pressed for payment. Referring to the incidents connected with the taking of notes mentioned yesterday, counsel claimed that he was entitled to disagree with a note even of an associate of a judge, who in this particular instance was a much younger man than himself,

His Honor, summing up, made particular reference to the evidence of the witness Southgate, and remarked that unless the latter had perjured himself then Player's evidence was true in substance and fact.
