NEW TRIAL GRANTED.
TAXI COMPANY'S APPEAL. INJURED MOTOR CYCLIST. (By Telegraph.—Press Association.) WELLINGTON, Monday.
Decision was given in the Appeal Court to-day in which the Black and While Cab Company, Ltd., appealed against the decision of the Supreme Court in refusing a new trial of the case in which Thomas V. Anson, of Lower Hutt, was awarded £1157 6/2 damages against the company as the result of a accident. . °
Anson, while riding home along the Hutfc Road on his motor cycle, was run down by a Black and White cab. One of his legs had to be amputated. The judges held that Mr. Justice Maedismissing the motion in the Court below for a new trial, had attached too much weight to the fact that the jury had viewed the scene of the collision, The motion for a new trial was allowed, with costs on the highest scale. Leave to appeal to the Privy CoiUK-il was gi anted, on the motion of consel for respondent, security being fixed at £500.
