DAMAGES CLAIM UPHELD.
COMMENTS BY MAGISTRATE

"Every motorist who has to pass cattle on a road must know that their movements are so uncertain that the greatest caution must be observed," stated Mr. F. W. Platts, S.M., in the Morrinsville Magistrate's Court, in giving judgment tor the full amount of a claim made by a Kereone farmer, James MoHardy, against Henry Money, taxi driver, of Morrinsville, for the value of a cow killed by collision with defendant's car.
The magistrate said it was the duty of the defendant to pass the cattle in such a manner that if a beast made a move he would be able to stop the car immediately. Money stated that he was travelling at a walking pace, and if this was so he should have had no difficulty in stopping. It was clear from the evidence that defendant was driving too fast and that he had not exercised the extreme care a motorist should use in such circumstances. He was satisfied that Money was guilty of negligence.
Judgment was accordingly given for tho amount claimed (£7 15/), with costs amounting to £2 9/.
