WAIMANA ESTATE DISPUTE.

FOURTH DAY OF HEARING.

ALLEGED REPRESENTATION.

The hearing of the claim of Charles Stanley Renshaw and Frank Herbert Renshaw (Mr. Glaister) for £145, alleged to be due to them by Frances Amy Adair Spinks (Mr. Milne), in connection with the sale of four sections in the Waimana Peninsula Estate, Northcote, was continued in the Magistrate's Court this morning before Mr. E.. C. Cutten, S.M. To-day was the fourth day of hearing. The claim is defended on the grounds of misrepresentation. Defendant alleges that she was influenced in her purchase of the sections by a statement made to her by one of the plaintiff's' servants that the harbour bridge would be begun within a year, and that the money for it was already deposited with the City Council.

On the Court resuming this morning, Alfred Oscar Otto, land salesman for plaintiffs, was submitted to a severe cross-examination by Mr. Milne. Questioned with regard to the harbour bridge, he said he had never taken any interest in the bridge, and that if it were built it would not affect the value of the sections in the estate.

"I am not an old man," said witness, "but I never expect to see a harbour bridge." A little later witness said: "The harbour bridge is only a joke in Auckland."

At the conclusion of plaintiffs' case Mr. Milne asked leave to call further evidence which had come within his knowledge since he closed his case. This was granted.

_ Alan Bruce Nicholson said that at the time of the alleged misrepresentation he was a land salesman in the employ of the plaintiffs. Witness stated that ho heard a conversation between Otto and defendant relative to the Waimana sections. Two bridges were mentioned. Otto said that owing to the agitation from the marine boroughs the harbour bridge would be started within 12 months.

Counsel for plaintiffs made a lengthy address to the Court, after which the case was adjourned until this afternoon.
