COLLISION IN COUNTRY.
LITIGATION OVER DAMAGE. APPEAL SUCCESSFUL. The sequel to a collision between two cars on the road leading from Pokeno to Te Aroha was heard in the Supreme Court on Monday, when John Bland Parker, of Maiingntawhiri, appealed against the decision of Mr. Wyvcrn Wilson, S.M.. in an action in which he was involved with George F. Friberg. of Heme Bay. Friberg. who was the plaintiff in the lower Court, alleged that the collision was cansed solely by the negligence of the appellant, and claimed £iC> 0/7 damages. Tho appellant not only denied negligence, but entered a counter-claim for damages. Tho magistrate found for tho respondent in the present action.
In his reserved judgment concerning the dispute, delivered this morning, Mr. Justice Herdman said that, in hie opinion, respondent failed to remove to hie correct side in good time, so the appeal would bo allowed, with £10 10/ and disbursements, and Magistrate's Court costs. As to the counter-claim, there was proof that repairs to appellant's car cost £">4. but no proof of general damage. He. would therefore be entitled to judgmuit in the Magistrate's Court for that sum.
