DELAY IN PRESENTATION.
MAGISTRATE'S DECISION

MORRINSVILLE, Thursday.
An. action which caused considerable local interest, as it was regarded as a test case, was heard in the Morrinsville Court last month, when W. J Eynon, contractor, of Morrinsville, sued R. G. Vivian, a well-known business man of the town, for the payment of £40, the amount of his surety in connection with a promissory note which he had backed regarding a loan of £220 Eynon had made to P. C. Warner, recently of Morrinsville, and now of Tauranga". In announcing his judgment at the Morrinsville Court yesterday, Mr. P. W. Platts, S.M., referred to the principal plea of the defence, that the demand note was not presented within a reasonable time of the due date, the note, one payable on demand, not being presented till after nine months. The magistrate held that the note was presented within a reasonable time.
Judgment was given for plaintiff for the amount claimed, with interest ( £4 10/) and costs.
Security for appeal was fixed at £20.
