A PROPERTY EXCHANGE.
PARTIES NOT SATISFIED. THE COURT TO DECIDE. (By Telegraph—Press Association.) DUNEDIN, Tuesday. An action arising from a dispute con- ' cerning an exchange of properties was commenced in the Supreme Court to-day, ' the plaintiff being Sydney Howard Shale, sheep farmer, of Christchureh, and tho defendant James Martin Samson, i auctioneer, of Dunedin. The statement of claim set out that ! in May, 192.3. plaintiff agreed to exchange , a sheep run at Glenlee, near Blenheim, I with stock, for a farm at Norwood, near : Christchurch, and a farm at Awania. Pos- I session was taken. Plaintiff alleged that j defendant made misrepresentations, and ! claimed rescission of the contract, with £1500, or damages of f IG,OOO for fraudulent misrepresentation or breach of warranty. The defence gave a general denial to the allegations, and counter-claimed for £13,200 damages for alleged fraudulent | misrepresentation or breach of warranty. |
