MORTGAGE ON A SHIP.
WAS THERE A PRIOR CLAIM?
APPEAL COURT TO DECIDE. (By Telegraph.—Press Association.) WELLINGTON, this day. The Appeal Court is engaged in hearing the case of Alex. Dunn, of Wellington, solicitor, against Harry Mundell, of Wellington, seaman, which involves a point of law of great interest to i«ortgagees of property. Mandell was injured on the steamer Huia in 1920, and obtained judgment in Wellington in 1923 for £316 and costs against one Williams, purchaser of the ship under the agreement. Williams afterwards became bankrupt, and left New Zealand: Dunn had three mortgages on the vessel, amounting to £2200. The question arose as to whether Mandell's claim took precedence over the mortgages, and Mr. Justice Ostler found that it did. Against this decision Dunn appeals. Messrs. Foden and Barton appear for appellant, and Mr. O'Regan for respondent.
