AN ORDER VOIDED.

- DRAINAGE OF STREAM. THE BOARD'S DUTY. (By Telegraph.—Own Correspondent) OPOTIKI, this .day. An order made on February 10 by _§ Hauntress Creek Drainage Board lot been declared by Mr. W. G. M ___!_■ S.M., to have no effect. The order in question directed Mr. C, Butterworth, as the owner of certaa land abutting on. the creek, to clear all obstructions from the bed of the stream. He appealed against this on varioni grounds, one of which was that it was the board's duty to do the work, covering the cost by striking a general Tate. This view was upheld by the magistrate, who said that having seen the stream in flood, and having heard the evidence of the engineer and various ratepayers, he was satisfied that" tie board should carry out the work by striking a higher rate, and that when the work was done the board should require ratepayers to keep the drains clear of weeds and obstructions. He therefore found that the board's order shall have no effect.
