UNDEFENDED DIVORCE.
ONE DECREE GRANTED.
ORDER FOR RESTITUTION MADE,
There was a short sitting of the Supreme Court this morning before Mr. Justice Stringer.
Desertion was the ground upon which Lavinia Henrietta Danks (Mr. Cahill, instructed by Mr. Fitzherbert) secured dissolution of her marriage with Frederick William Danks. The parties were married in July, 1899, and liven in various places* in New Zealand. In 1917 they agreed to separate, and had not lived together since. There were two children of the marriage. The petitioner had maintained herself during the time she had been away from her husband. A decree nis was granted with costs on the lowest scale against the respondent. Victor Percy Stuart (Mr. Cahill) applied for an order of restitution of conjugal rights against Thelma May Stuart. Married on December 24, 1919, the parties could not agree. Petitioner said his wife was too fond of a gay life, and was always at dances. He remonstrated with her, but it was no good, and on October 31, 192.5, she left him, and had not lived with him since. An order that she return within fourteen days was made.
