These were Smith, who made the sensational dash from the Kotorua j Express in the Newmarket tunnel on 'Tuesday of last week; Moyne, who is now in custody; and Phillips, who was bailed and failed to appear on February 13 when his name was called in the 1 Auckland Police Court. j This morning, at the Police Court, j Chief Detective Cummings made appli- ! cation for the estreatment of bail. He i stated that Phillips had been bailed in j the sum of £500, himself for £250 and a surety of £250. He had failed to fulfil his obligations and could not be located I despite the inquiries that had been made. ! Apart from the surety of £250 in cash, ! the police "also had a new motor ear which belonged to Phillips. Mr. Ward, who appeared for the man" who acted as surety for Phillips, said I that his client had given the police every j assistance. Although the matter was ■ one for the discretion of the Magistrate, I Mr. Ward thought that as the police ; had in their possession a new car, that I the £250 should not be forfeited. !
