GRANTED PROBATION.
MEN FROM THE COUNTRY, j DRINK THEIR TROUBLE. | Probation was granted by Mr. Justice '. Stringer this morning .to Matthew Murphy and Albert Alfred Ellis, who ; stood together in the Supreme Court dock", having pleaded, guilty to: (a) j Breaking, entering and theft,, lb) breaking" and entering with intent to commit a crime, and (c) attempting to break and enter with intent" to commit a | crime. . . Mr. Allan Moody, who appeared for prisoners, stated that they were before | Mr. Justice Reed in December, but were remanded pending the receipt of the ; police report. Counsel understood that i this report showed that the offences j were committed' while the men were | under the influence of liquor. Drunken- • ness was their trouble. They had both been in gaol since they were committed | for sentence at Whakatane on Decem- j ber 15. Mr. Moody suggested that if 111= Honor would give them a chance to ! rehabilitate themselves under the quid- I ance of the probation officer, they might be kept in town to work. His Honor: 'due man is married and on a farm. I think he should go back — ' I don't'say without some little interval. j you know : ; The probation officer (Mr. Campbell), said that both men were addicted to | drink and would be better in the coun- j try. T . , "I think this is a case where I might reasonably grant probation." said the | Judge. ""It seem* obvious that' the I mcn = committeti the offences while under the inriuence of liquor. No attempt was made to di.-rose of the property, all of which has been recovered. '" Each prisoner was placed upon pro- I bation for three years upon the statu- j tory conditions, and in addition, that, they take out prohibition orders and - maintain the same during the currency : of their probation. They were also , ordered to pay £2 6/ each towards the, cost of the prosecution.
