FALL OVER EMBANKMENT.
MOTION FOR NONSUIT. DECISION RESERVED. Lengthy argument on the question of a nonsuit and a new trial in the case in which James Francis Attwood (Mr. Richmond and Mr. Kirker) was awarded £400 damages against the Auckland City Council "(Mr. Stanton), was concluded at the Supreme Court yesterday afternoon before Mr. Justice Reed.
Mr. Stanton moved for the nonsuit and new trial on the grounds that the verdict of the jury was against the weight of evidence. The plaintiff Had claimed that he fell over a raised footpath owing to the fact that the locality was inadequately lighted. Mr. Richmond moved for judgment on the verdict of the jury.
His Honor reserved his decision in each case.
