SALE OF WINE.
APPEAL AGAINST CONVICTION. COURT GRANTS AMENDMENTS. A reserved judgment was delivered by Mr. Justice Reed at the Supreme Court to-day in an appeal from the Magistrate's Court against the conviction of appellants. Joseph Balich and Marko Buljan (Mr. Greville) for breaches of the : Licensing Act. The respondent was James Coghlan Griffiths (Mr. Paterson). The appellant Balich was a licensed winemaker and Buljan was his traveller. The dispute, arose out of a sale of wine last November. On November 10 Buljan wrote to defendant asking that 31 cases of win* for which he represented that orders had been signed, be got ready for him to take for delivery at Pukehuia. Buljan was unable to enumerate the persons #ho had ordered the 31 cases. He delivered six cases from the stock and made "new sales without sending orders to the vineyard." The statute required that delivery to purchaser must be made at the place specified in the license. Balich's part in the transaction was that, without knowledge of names of the alleged purchasers of their addresses, he consigned the 31 cases of wine to his agent Buljan. This method of sales constituted delivery at Pukehuia and not at the vineyard. His Honor found that Balich was guilty of an offence under the Licessni" Amendment Act. Buljan, having a3 a sisted and procured the commission of the offence, was liable to the same punishment as Balich. An order waa made amending the conviction in the case of Balich to a conviction for delivering wine from a place other than specified in his licence, and in the case of Buljan to a conviction for aiding in committing the offence. The convictions wore amended accordingly and the appeal was dismissed, (
