MISLAID THE AWARD.
THREE ASSISTANTS UNDERPAID. A STOREKEEPER FINED. A rather unusual excuse that he had mislaid his copy of'the award and was unaware of ita provisions at the time the inspector called was advanced by A. C. Wallace, storekeeper, of Kohukohu in the Magistrate's Court at Rawene, when he was proceeded against by Mr. J. Hollows, Inspector of Awards, for employing three assistants at less than tbe award rate of wages. Mr. W. H. Kirkpatrick appeared for defendant, and admitted the three charges. He assured the Magistrate, Mr. F. H. Levien, S.M., that the arrears amounted to not more than £53 14/, and added that these would be paid. ' Mr. Levien stated that in cases of this nature he required to be satisfied that the arrears would be paid, as it was his rule to make the penalty commensurate with the amount that the employer had actually benefited by. However, on being assured by defendant that the arreara would be paid over in the presence of a constable, a penalty of £2 on each of the three charges was imposed. The defendant was ordered to pay £3 15/, costs of the inspector, Court costs, 15/, a total of £10 10/. : Proceedings were also taken against S. B. Maxwell, an employee, for accepting from defendant less than the award I rate of wage. In this case a penalty of £1, with 30/ costs, was imposed.
