APPORTIONING THE LOSS. A lengthy case was beard by Mr. E. C. Cutten, S.M., at the Magistrate's Court yesterday. Edwin Saves (Mr. Ralph E Taylor) sued Frederick Francis Fabian fMr. Blakey) to recover £196 12/3. Plaintiff and defendant were partners in a magazine. The business was carried out at a loss, and defendant notified plaintiff of his intention to withdraw from the partnership. Plaintiff then claimed from defendan £161 2/3, stated to be his proportion of the loss sustained. The defence set up was that there had been overcharge for printing and also commission. After hearing expert evidence. Mr. Cutten said it was evident plaintiff was entitled to something, but not the full amount claimed. It was a matter that should be arranged between the parties. He would reserve his decision, and not give one, unless asked for by. the. parties to the dispute.
