ORDER AGAINST DEBTOR.
POSSESSION OF CHEQUE ADMITTED
An admission by a debtor, an old man about seventy years of age, that he had £4 10/ on his person, gave an unusual turn to an application for an order under a judgment summons in the Magistrate's Court this morning. The magistrate, Mr. E. C. Cutten, S.M., said that 'the debtor would have to pay the amount into court towards discharging his debt, but tbe old man protested that it was not his money. It was a cheque and Was not in his name.
Mr. Cutten: Then I have no alternative but to send you to prison. It is quite clear from the evidence that you have stated that you have £4 10/.
The debtor stated that the cheque had been drawn by his wife. If he were to pay the amount into court he would be a thief and he would rather go to prison than be that.
His Worship said that he would make an order for imprisonment to be suspended for 21 days pending the payment of £4 10/ in cash and £1 5/ a week, the first weekly payment to be made from wages to be received for work which counsel for the creditor undertook to get for the debtor.
