CLAIM FOR DAMAGES.
A sequel to a collision in Manukau Road some months ago between a motor cycle ridden 'by Ernest Albert Klanigan and a motor lorry belonging to Sanford, Ltd., was a claim in the Magistrate's Court yesterday -by Klanigan (Mr. J. •). Sullivan) for £50 damages to his cycle, £".0 general damages, and _ij for general expenses. The evidence covered the general circumstances leading up to the collision in order to allocate the blame for the accident, and evidence as to the actual damage incurred by plaintiff's cvde. After having heard evidence at length. Mr. Poynton, S.M.. held that chief culpability in connection with the accident rested with the driver of the lorry, but that the damage claim was excessive in view of the fact that plaintiff had paid only Cl-") for the cycle sonic months before the accident. Judgment was given for £:ll 7/ general damages and expenses, the amount to be allowed for the cycle to -be lixed later. At the request of Mr. Ward, for the. defendants, bis Worship lixed security for appeal at Clii 1-V. plus the amount of the judgment.
