DISPUTE OVER IDENT-FICATION". A recent arrival from England. Joseph -Tones (Mr. 'Biernaeki) sued H. E. Buckley (Mr. Kirkex), a land agent, for the return of £_5 deposit and £25 damages at the, Magistrate's Court yesterday afternoon, the outcome of ne*gotiatronfor th-e purchase of a house in Costley Street, Ponsonby. Plaintiff contended that he arranged to purchase, after inspect---., a dwelling, N"o. 5, and clinched the -barjrain by paying a deposit of £20, rece'-ving a receipt for ""House -s"o. 5." When he went to tbe house to arrange with the tenant E*__-ut obtaining possession he was informed -that the latter bad no of disposing of the property. The plaintiff came to the oonc-asion that the house next door had been sold to him, and co*iseq"_ently -wished to call tbe deal off. The soit-t-k-r* of ifh-e matter, a-eord-in (T to defendant, was tfcat plaintiff had decided not to buy the house, and in order to escape the obligation of buying had concocted the contention that be had been sold the wrong house. T-re magistrate said there -was n-t'h-i_-r in the transaction discreditable to edtrhcr party, being of th- opinion that a mistake had been made. He gave judgment for the amount of th-e deposit claime-d with interest (r>/). The claim for damages was d-smissed.
