An interesting case of disputed possession ac the result of the sale of a piece jof land fronting Grey Street, Onehunga, ! for failure to pay the rates, came before 'Mr. Justice Chapman at the Supreme ! Court this morning. The plaintiff was Nellie Hay (Mr. Hall Skelton), and the defendant William Wade (Mr. A. E. 'Skelton). ! The statement of claim set forth that lon March 22, 1915, the Onehunga Bor I ough Council obtained judgment against Catherine Wade, the owner of certain .land in Onehunga, for £13 4/4 for rates land 15/ costs. That judgment was never satisfied, co on February 12, 1018, the council forwarded to the registrar of the Supreme Court a certificate of the i judgment in the form required by *ecj tion 73 of the Bating Act, 1908. On May 13, 1919, the registrar of the Supreme I Court caused the land to be sold at pub {lie auction, and the plaintiff purchased |it. It was claimed now that the defendant, who is a son of Catherine Wade, had been in unlawful posseseion of the land, amounting in all to 2 acres 11 i perches, since or about May 13, 1915% I and had refused the request of the plain itiff to cease occupation.
