SHOP HOURS.
MAGISTRATE'S RULING CHALLENGED. (By Telegraph.—Press Association.. WELLINGTON, this day. The secretary of the Labour Department states that the decision given by a Timaru magistrate recently will be "the subject of Supreme Court appeals. Proceedings in the> case were brought under section 25 .of tlie Shop and Offices Act (providing that shopkeepers may ask the Minister to fix the closing hours in the evening.') The Chief Justice ruled that "evening" means about the time of sunset. Subsequently Parliament inserted an amendment in the Act defining "evening" as a time of day not earlier than five o'clock in the afternoon. The Timaru magistrate relied on, and gave his decision in accordance with, the Chief Justice's ruling, which, he held, was not over-ridden by the legislation amendment. Against this the Departmsnt is now appealing.
