GOES TO PRIVY COUNCIL. (By Telegraph. —Press Association.) WELLINGTON, this day. Tn the appeal ease M. Tarbiitt and others v. Nicboleon, final leave was granted to appeal to the. Privy Council. The matter at issue is the interpretation of the will and two codicils of Patty Maria Xuttall. spinster, of Auckland, who died on June IT, ISHfi. A property of 69 acres was devised to George Tarbntt, Who predeceased her. Defendants contend that the bequest lapsed. Plaintiffs contend the gift was saved from lapse by a declaration in a residuary clause. " Mr Skerrctt, K.C., and Mr. Meredith appeared for plaintiffs, and Mr. Reed, K.C., and Mr. Napier for defendants.
