TRIAL BY JURY.
MELBOURNE, this day. The High Court of Australia dismissed the appeal in the Bern.isconi t-ase. Judge Murray stated a special case, the main point being whether 8.--.-nasconi had the right to claim trial by jury. The Chief Justice said that the section of the Constitution providing for trial by jury related only to offences created by Parliament by statutes, passed in the execution of its functions, and described a* law s of the Commonwealth. The request for a jury therefore was rightly- refused. Mr. J-ustiee Isaacs and Justice Rich concurred. Beraaseoni was sentenced to a year's imprisonment at Port Moresby, New tJuinea. on a charge of hanging a native boy to the roof of a store as a punishment. The prisoner maintained that he was entitled to have t'hc ease tried by a jury, and Judge Murray agreed to state a case for the High Court.
