TI-TREE CUTTING CONTRACT.
I*KSUCCESSFtX CLAIM. (By Telesraph—Own Correspondent.) HAMILTON. Thursday. Reserved judgment was delivered by Mr. K. Kawson. S.M.. at Hamilton, yesterday, in which Alfred Huston claimed for \\". H. Mathers and Sons, of Te Rapa, £41 17' ii for rutting ti-tree. Originally the contract was het"'eeu plaantiff and a man named O'Shea. who relinquished it later, leaving plaintiff to complete it. After cutting 4:J acres, plaintiff stopped work, partly because defendants had told him they would not pay him unless he completed the whole by an agreed date, and partly because he was not feeling well.
Tlic Magistrate held that the contract was an indivisible one. under which plaintiif was not entitled lo any payment unless he completed the whole of the work. Plaint iff was therefore nonsuited.
