COAL VEND CASE
HEARING OF THE APPEAL. (Received 10.15 a.m.) SYDNEY, August 26. The hearing of the appeal by the shipping companies in the coal vend case I has commenced before the High Court. The chief ground of appeal relates to the admissibility of certain evidence, particularly to evidence relating to the vend's minutes prior to the date of the alleged combination. It is contended that the minutes of the vend are not evidence against the shipping appellants. A very strong bar is engaged. The appellants are the Adelaide Steamship Company, Howard Smith, Huddart, Parker, and Mcllwraith, McEachern and Co. The grounds of appeal include that the alleged wrongful act arose from the coal vend agreement, with which appellants had nothing to do, and the evidence failed to establish any intent to restrain or control the supply or price of any service merchandise commodity by appellants or any other defendant.
