INCOME TAX APPEAL

' Mr. Justice Williams gave judgment in Dalgety's sad other appellants versus the Commissioner of Taxes, aa appeal from the decision of a magistrate overruling objections to assessment of income for income tax purposes. The question was what were the profits darived by appellants from the >»«d«Vws; or occupation of Crows lands for the year ending March 31, 1910, which was the; last year the appellants carried on, and during which they held a clearing sale. The judge held that the exception contained in the subsection could not be construed as an exception to prohibition from deduction, and the appeal was dismissed with costs, £lO.
