ACTION FOR DIVORCE. JUDGED COMMENDATION. A petition for divorce lodged by Thomas Cargill, chief engineer on the Paloona, against Mary Jane Cargill, with Michael McClair named as co-respondent, adultery being the allegation, was heard by Mr. Justice Edwards at the Supreme Court this afternoon. Mr. J. R. Heed represented petitioner, and there was no appearance of respondent or co-re-spondent. The parties were married on March 2, 1893, at Fitzroy, Melbourne, and lived happily together for some years, till in 1898 and 1899 Mrs. Cargill, who had gradually .been succumbing to drink for some time, completely g*ve way, associated with immoral people, and' was several times picked up in the street in an intoxicated /condition. Several efforts were made to reclaim the woman, and the aid of the Sisters of the Catholic Church was invoked, but all to no purpose. In 1900 petitioner left his wife, but paid her an allowance of £2 a week from that year up to November last, when he reduced the amount to £1 a week because of what he had heard, and had continued to pay the latter sum up to the present time. Evidence was given that respondent and co-respondent had lived together in rooms, and also in a a married couple. "This petitioner has behaved with extraordinary generosity towards his wife," remarked his Honor in granting a decree nisi, to be made absolute in three months. No costs were asked for.
