ONEHUNGA MAGISTRATE'S COURT.

A sitting of the Onehunga Magistrate's Court was held this morning, before Mr. E. C. Ctttten, S.M. Sergeant' Rogers appeared for tiie .police. Claim for Possession of a Tenement. — W. Morton sued R. Baker for-possession of a house. He said the fa-mliy had been a nuisance for a long time, and had done damage to the extent of £35. An order was given for possession within seven days. Breach of By-Laws.—J. J. Boyd was charged with a breach of the borough bylaws, in erecting buildings in Symondsstreet, Onehunga without lirst obtaining a permit for such buildings. Mr. Zi.nan appeared for the Onehunga Borough Council. The evidence showed that defendant had erected ten sheds on his property in Symonds-street, for the purpose of a 7.en ) without obtaining any permit. For Ihe defence it was urged that -defendant hud iwen informed that there was nothing in the by-laws against, zoos, auo he had .ecu led to believe that there would be -no trouble about it. Tho whole trouble had been started by a petition got up by residents in the vicinity, who objected to a zoo being established in the neighbourhood. The Council did not press for a -heavy penalty in the oaso as they only wanted to define the law on the matter. Defendant was convicted and fined 10/ and costs 9/.
