Davidson sued William Rashleigh, who was defended by Mr Walker, for the return of £6, alleged to have been paid as a deposit upon a waggon which the plaintiff stated was agreed to be built and delivered by October Bth last. The vehicle was not completed as arranged, and as he had sold out of the business lie declined to take it, as it was of no use to him. The agreement was verbal. "After hearing the plaintiff and a witness called by the defendant. His Worship decided tiiat the plaintiff's story was correct, and gave judgment for the full amount with costs.
