COOKS AND STEWARDS' AWARD

During the recent sitting of the Arbitration Court in Wellington the question was raised as to whether the Hud-dart-Parker Proprietary was bound by the award obtained by the Wellington Cooks and Stewards' Union. The Court provisionally dealt with the question by making the company a party to the award. The contention of the company was that as it was incorporated in 'Victoria, and its steamers were registered in Melbourne, the New Zealand Court had no jurisdiction over it. The reply of the union to this was that the company's vessels carried both passengers and goods coastwise between seven of the principal ports of New Zealand and within four industrial districts. The Court was asked to decide these issues. The judgment of the Court was received to-day. In making its decision, the Court stated that in dealing with the questions raised, certain considerations, which had a very wide, application, had to be borne in mind. There were shipowners in New Zealand in a position analogous to that of the Huddart-Parker Company. The Union Steamship Company was incorporated in New Zealand, had its boats registered at Dunedin, and traded to and in Australia. Payment for holidays and overtime were two points upon which there might be cltsli of interests as between the Commonwealth and the colony. The Court believed that in some respects the Hud-dart-Parker\s vessels were local trading boats, and that the company had been properly made a party to the award. The exact extent to which it is bound will have to be left to be determined when the question arises.
