DEFENDED CASE.
Wilkinson v. Slator. —In this case William Wilkinson sued James Slator for £4 2/6, cost of printing 850 copies of a pamphlet. Plaintiff stated that he agreed to have the pamphlets ready for delivery prior to the departure of the English mail of August 17. The pamphlets were ready on the day before the departure of the mail, but he refused xo deliver them until the money had been paid. The defence was that there was no stipulation that payment should be made before delivery, and that the final price fixed on was £8. Judgment was entered for plaintiff for the amount claimed with costs 29/.
