Russell v. Sims: An appeal from the decision of Colonel Eoberts, stipendiary magistrate at Tauranga. The plaintiff, Russell, is a doctor, and he sued the defendant Sims for medical attendance. At the time of rendering the service he was registered as a medical practioher in England, but not in New Zealand. When the ease was called on it was proved that between that time and the time of rendering the service to the defendant the plaintiff had been registered in New Zealand. The magistrate held ■that the doctor must have been registered in the colony at the time he rendered the service before he could sue for his fees. This decision was appealed against. Mr F. Wilson Smith appeared for the petitioner, end Mr C. E. Button for the respondent. The section in the Medical Practitioners' Act, ISC'), upon which the point turned, is as under: —"No person shall be entitled to sue in any Court of law in New Zealand for any medical or surgical advice . . .
