POLICE COURT.
Saturday's sitting of the Police Court was presided over by Mr W. H. . Brabant, S.M.. For drunkenness Charles Buckley, John Inkster, Walter Townsend, and John James Murphy were? each fined 20/ or 7 day's hard labour, Michael Carey 10/ or 48 hours, and a first offender 5/ or 24 hours. Four first offending inebriates were convicted and discharged. A charge against Fredk. S. Follas of having used threatening behaviour in Ox-ford-street was dismissed, the evidence showing that the accused acted in self defence. Thomas James Steele pleaded not guilty to a charge of cycling on the footpath in Manukau Road, Parnell. Sub-Inspector Wilson prosecuted, and Mr Hanna,defended. The latter sub-, mitted (1) that the Public Works Act 1894, under which the charge was laid, did not define, a bicycle to. be a vehicle, but differentiated a cycle from a vehicle; (2) that a road under the Public Works Act was not a road as defined under the Municipal Corporations Act, the Public Works Act only applying to roads outside the borough; and (3) that any offence brought under, the -Public Works Act was not an offence in a borough.
