CHARGE AGAINST A SOLICITOR

WELLINGTON, Wednesday
In the Supreme Court to-day the second hearing of the charge against William Nichol Ca.th.ro, solicitor, of having misappropriated the sum of £1084 Is lOd belonging to O, Prior, solicitor, of Feilding, in which a previous jury disagreed, was gone. into. Mr Gray, who appeared for the Crown, said the Crown was now in a position to absolutely disprove the accused's story that he .had been robbed of the money in Wellington on a Saturday night, . and two witnesses swore to seeing Cathro m Palmerston North on that same Saturday night. Judge Denniston, in summing up, said the only way in which the accused had attempted to account for the loss of the money was by what had practice ally been admitted to be a deliberate lie and perjury. The jury returned to court at halfpast eight p.m. and the foreman announced that they were unable to agree. Judge Denniston accordingly discharged the jury. The Crown Prosecutor applied for a new trial, with fresh panel, but the question was held over for consideration till the 17th inst.
