MAGISTRATE'S COURT.
THIS DAY,
(Before Mr T. Hutchison, S.M.) DEFENDED CASE. George .Mitcliison vA. Scholium, claim $39 10s, "for wages. Mr McAlister appeared for the plahtiff and Mr Reed for the defence. Plaintiff stated that fie was engaged by defendant as manager of the litter's place at Tiri Tin, at 30s a week. After, remaining there about two months he was removed to the defendant's store in tie capacity of hook-keeper, on the understanding that his wages were to bs 39s and keep. He was not paid CTlarly, however, and on this acsait left tile defendant's employ on the iMnst. He had only received £15 from Jefendant to cash .and clothes. For the delence it'■was1 stated that plaintiff was simply engaged as a handy man, not a 'book' keeper, at 10s a week and keep. The plaintiff came to defendant in a destitute condition, and the latter engaged him out of charity as he was unfit for manual work. His duties at Tiri were practically nominal, and .the man there before had only received 12s a week. The defendant said he had 200 men in his employ, and could get plenty of good hands at 203 a week. Several witnesses were examined for the defence.—His Worship held that the engagement was for 10s a week, which would make the amount of wages due to the plaintiff 15s. Judgment accordingly for plaintiff for 15s.
