opinion of the city-Solicitor.
To-day Mr Thos. Cotter, city solicitor; forwarded his opinion to the Town Clerk re the Shop -and .Shop Act. ' Mr Cotter states that the, Council in passing the resolution on Thursday night requested the-Mayor to do whab, in his opinion, ha had no power to do, namely to proclaim a half holiday. . To be legally effective, any proclamation declaring any particular day or part of a day a holiday or a public holiday er ihalf-holid&y wouid require to be made by Hia Excellency the Governor and not by His Worship the Mayor.' If the Mayor, instead- of proclaiming a haltholiday, invites the citizens to -observe one, then, in Mr .Cotter's opinion,'such obeervance by any citizen would nob make the time observed a public holiday or halfholiday within the meaning of the Act. The Mayor will not incur, any legal responsibility in issuing such an invitation, and if any citizen thinks fit to observe it, and then opens on Saturday instead, and ia proceeded against for so doing, the quo3tion can then be raised and judicially decided, as to the legal effect of such invitation and observance.
