The case occupied the whole afternoon, and was hot v concluded till 6.30 p.m. Evidence Waa' adduced as to it nob having {been , worked in accordance with the regulations. The whole case, ' howerer, brought on the question as to which Act the holding was held, whether that of 18S6 or 1891. Mr ' Miller contended that if ib was originally held under the Acb of 1886, by section' 9 o! the Acb of 1891 all licensed holdings held under the Acb of 1880 come under the provisions of the Acb of 1891, which only gives the Warden power to forfeit and "dispose of by auction, not to grant it to the firsb applicant, which is what): complain an bin this case asks for. Mr T. Cooper, however, claimed that the holding was held under the Act of 1886, which U authorises its forfeiture for non-compliance/ i of regulation' and granting to firsb appli- . cjunb.
