PROCEEDINGS AT THE POLICE

COURT.

THE CASE DISMISSED.

This morning, ab the Police Court, before Mr H. W. Northcrofb, S.M., James Badley waa charged that, on the 28th -September, he did expose, in Durham-street, a certain horae for show, the said street not being a fair or marked lawfully appointed for that purpoee. Mr H. Campbell; for defendant, pleaded not guilty.

Inspector Hickaon stated that after the recent; sad accident in Durhatn-atreot he gave instructions to the horse auctioneers that triala would not be allowed in Durhamstreet in future. A constable had warned defendant, bub he persisted in driving a horae from Durham-street to Queen-street " showing it off."

Sergeant Gamble deposed to cautioning Mr Buckland, junior, that if horses were brought out for trial any more, proceedings would be taken against the offender.

Constable MacConochie deposed to cautioning defendant in Buckland'a yard on the afternoon in question. Defendant, replied, "I don't think you can stop it." Witnesa remained in Dut ham-street for snmetime. Subsequently he walked down Quoen-streeb about 200 yards and then walked back to Durharn-atr6et. Defendant had led a horaa attached to a cart with weights in it into Dnrham-streefc. Defendant took the carb down into (Jjueensireet, and then brought it back to Buckland's yard. Witness took defendant's name. The Traffic Inspector for the city gave corroborative evidence. P. A. Philips, Town Clerk, deposed that no part of Durham-street is set apart for a fain or market. Mr Campbell: I admit) that. Thi3 was the evidence. Mr Campbell submitted that} there waa no ca3e to answer. He contended the defendant had a right to use the. etiteeta in the manner he did just the same as any other citizen who drove hia carriage along the roar). Mr Northcroft said the information 1 charged the defendant with exposing the horae for " Bhow." He hardly thoueht that in the present case when the horso had been aold and waa undergoing a trial after the sale, that it could ba said that it was being exhibited for show. He would dismiss the information.

A similar charge against Denis Harford waa withdrawn.
