(BY TELKGRAFH.—PRESS ASSOCIATION.)
Welusgton, this day.
In the Suprema Court to-day, an action was brought by Mr Skey, the Government Analyst, aa executor in the estate of hi 9 son, Eraest Torecover, claiming from the Mutual Life Association of Australasia £1,500, the amount of a policy on the eon's life. The quarterly payment for renewal of the policy fell due on October Ist, but young Skey took advantage of the 31 days grace, and on November Ist, when asked for payment, he gave a cheque for the amounc, and remarked that the cheque should be held until the 10th November, when it was presented and dishonoured. He asked for an extension of time un.til the 15th Nov. This was granted, but the Company's agent alleges he told Skey bis life would not be covered. On the 15th Nov. Skey was killed by a traction engine in Featherston. On the following morning the renewal premium wav paid inco a country bank..to the Company's credit, but was declined by the latter. The question id whether payment by a cheque, which was dishonoured, was a legal payment. The case is proceeding.
